TERMS AND CONDITIONS

These Terms constitute a legally binding agreement between you and Psychic Alchemy LLC. By accessing any platform, booking a session, purchasing a product, subscribing to any content, joining any membership, or engaging any service, you agree to be bound by these Terms.
ARTICLE 1 — SERVICES AND CONTENT OFFERINGS
1.1 Description of Services and Content
Healing and Consultation Services:
Individual intuitive and psychic readings (in-person, by phone, or via video)
Clairvoyant healing sessions (in-person, by phone, or via video)
Energy work and energetic clearing (in-person, by phone, or via video)
Spiritual coaching and guidance (in-person, by phone, or via video)
Group sessions and workshops (in-person, by phone, or via video)
Digital Content and Media:
YouTube programming including shows, interviews, educational series, and live streams
Substack publications including newsletters, essays, articles, and subscriber-only posts
Social media content across X (formerly known as Twitter), Facebook, Instagram
Digital Products:
Recorded sessions and audio/video downloads
Online courses and educational programs
E-books, guides, and written materials
Meditations and guided audio content
1.2 Service and Content Modifications
The Company reserves the right to modify, suspend, discontinue, or change the pricing of any service, content, or membership tier at any time. The Company will provide 30 days notice of material changes to paid membership terms where reasonably practicable.
1.3 Practitioner and Creator Information
The Company's lead practitioner holds a Bachelor's and Master's degree in Public Policy from the University of Chicago and has practiced clairvoyant healing since 2013.
ARTICLE 2 — BOOKING AND APPOINTMENTS
2.1 Booking Process
Sessions may be booked through SquareSpace with Acuity Scheduling. Booking constitutes acceptance of these Terms and the Client Services Agreement.
2.2 Confirmation
A session is confirmed only upon receipt of full payment or deposit as specified at time of booking and delivery of a confirmation communication from the Company.
2.3 Preparation
The Company reserves the right to reschedule a session if the Client appears to be under the influence of alcohol or controlled substances, or is in a state of acute mental health crisis requiring immediate professional intervention.
2.4 Session Duration
Sessions that begin late due to the Client's tardiness will end at the originally scheduled time unless the Company agrees otherwise at its sole discretion.
ARTICLE 3 — FEES, PAYMENT, AND REFUNDS
3.1 General Fees
Current fees are listed on the relevant platform and are subject to change. Fees in effect at the time of booking, purchase, or subscription apply.
3.2 Payment
Payment is due in full at time of booking, purchase, or subscription initiation unless otherwise agreed in writing. Accepted payment methods: Cash, Venmo, ApplePay, Visa, Mastercard, Check.
3.3 Cancellation by Client — Healing Services
(a) Five-Day Statutory Right of Cancellation (California BPC Section 17539.185):
For any service contract exceeding $25.00, the Client has the right to cancel and receive a full refund within five (5) business days of signing or making payment, provided services have not yet been rendered.
(b) Standard Cancellation Policy:
More than 24 hours notice: Full refund or credit at Client's election.
12-24 hours notice: 25% of session fee charged; remainder refunded or credited.
Less than 12 hours notice or no-show: Full session fee charged; no refund.
3.4 Subscription and Membership Terms
(a) Billing Cycle:
Membership fees are billed on a recurring monthly or annual basis as selected at enrollment. Billing occurs automatically until cancelled.
(b) Cancellation by Client:
Members may cancel at any time through e-mail. Cancellation takes effect at the end of the current billing cycle. No partial refunds for unused portions of a billing period.
(c) Annual Subscription Cancellation:
Annual subscriptions may be cancelled within 14 days of initial purchase for a full refund, provided no premium content has been accessed. After 14 days, annual subscriptions are non-refundable but remain active through the end of the paid period.
(d) Price Changes:
The Company may change membership pricing with 14 days advance notice. Continued subscription after the notice period constitutes acceptance of new pricing.
(e) Platform-Specific Subscriptions:
Subscriptions processed through YouTube, Substack, or other third-party platforms are also subject to those platforms' refund and cancellation policies.
3.5 Digital Product Refund Policy
All sales of digital products are final and non-refundable upon delivery or access, unless the product is defective, materially different from its description, or a refund is required by applicable law.
3.6 Chargebacks
In the event of an unauthorized chargeback after services have been rendered, the Company reserves the right to dispute the chargeback and pursue recovery through all available legal means including small claims court in Stanislaus County, California.
ARTICLE 4 — CLIENT AND SUBSCRIBER CONDUCT
4.1 Age Requirement
Services are available to individuals 18 years of age or older.
4.2 Community Standards
The following conduct is prohibited in all Company community spaces:
Harassment, bullying, threats, or abusive language toward any person
Discrimination based on race, ethnicity, gender, sexual orientation, religion, disability, or any protected characteristic
Sharing other members' personal information without consent (doxxing)
Spam, unsolicited promotion, or commercial solicitation
Sexually explicit, violent, or otherwise inappropriate content
Sharing premium or paywalled content outside the platform without authorization
Impersonation of the Company, its practitioners, or other members
Any conduct that violates applicable law
Violation may result in immediate removal, suspension or termination of membership without refund, and prohibition from future participation.
4.3 Prohibited Conduct — Content Platforms
With respect to all Company content platforms, you may not:
Download, reproduce, redistribute, or publicly display paywalled content without authorization
Screen-record, screenshot, or capture premium content for distribution
Share login credentials or membership access with non-members
Use Company content to train artificial intelligence models without written consent
Remove or circumvent any digital rights management or access controls
Create derivative works from Company content without written permission
Use Company content for commercial purposes without written permission
ARTICLE 5 — INTELLECTUAL PROPERTY
5.1 Ownership
All content created by Psychic Alchemy LLC is the exclusive intellectual property of Psychic Alchemy LLC, protected under applicable United States and international copyright, trademark, and intellectual property laws. This includes without limitation:
All YouTube videos, shorts, live streams, and channel content
All Substack newsletters, posts, articles, and subscriber content
All podcast episodes, show notes, and audio content
All membership portal content including exclusive posts, videos, and community content
All course materials, modules, workbooks, and educational content
All website content, blog posts, and written materials
The Psychic Alchemy name, logo, marks, and brand identity
All methodologies, frameworks, and proprietary approaches
5.2 Limited Personal License
Upon purchase of a digital product or active paid subscription, the Company grants a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the applicable content for personal, non-commercial purposes only.
5.3 DMCA Policy
If you believe your copyrighted work has been used without authorization on any Company platform, submit a DMCA takedown notice to:

5.4 FTC Disclosure
Sponsored content will be labeled as 'Sponsored,' 'Ad,' or 'Paid Partnership.' Affiliate links will be disclosed clearly. Editorial content is not influenced by sponsor or affiliate relationships.
ARTICLE 6 — CONTENT PLATFORM SPECIFIC TERMS
6.1 YouTube
YouTube content is additionally governed by YouTube's Terms of Service at youtube.com/t/terms. YouTube channel memberships and Super Chat transactions are processed by Google/YouTube subject to YouTube's payment policies.
6.2 Substack
Substack is additionally governed by Substack's Terms of Use at substack.com/tos. Paid Substack subscriptions are processed through Substack's payment system.
6.3 Podcast Platforms
Podcast content is distributed through Apple and governed by their respective terms. Podcast episodes are provided for personal listening only and may not be downloaded for redistribution or commercial exploitation.
6.4 Membership Portal
Access to membership content is contingent on an active paid subscription in good standing. Members who share access credentials or premium content will have membership terminated without refund and may be subject to legal action for copyright infringement.
ARTICLE 7 — DISCLAIMERS AND LIMITATION OF LIABILITY
7.1 DISCLAIMER OF WARRANTIES: SERVICES AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
7.2 LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, PSYCHIC ALCHEMY LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO THE USE OF SERVICES OR CONTENT.
7.3 CAP ON LIABILITY: IN NO EVENT SHALL THE COMPANY'S TOTAL LIABILITY TO ANY CLIENT EXCEED THE AMOUNT PAID BY THAT CLIENT FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
7.4 Indemnification
Client agrees to indemnify, defend, and hold harmless Psychic Alchemy LLC and its members, managers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) Client's use of Services; (b) Client's violation of these Terms; (c) Client's violation of any third-party rights; or (d) any actions taken by Client based on information received during a session.
ARTICLE 8 — DISPUTE RESOLUTION
8.1 Informal Resolution
Before initiating any formal proceeding, the parties agree to attempt in good faith to resolve any dispute through direct communication. Client shall provide written notice to jesus@psychicalchemy.com, and the parties shall have thirty (30) days to attempt informal resolution.
8.2 Mediation
If informal resolution fails, the parties agree to submit to non-binding mediation in Stanislaus County, California before initiating arbitration or litigation. Costs of mediation shall be shared equally.
8.3 Binding Arbitration
If mediation fails, any dispute shall be determined by binding arbitration administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures, with one arbitrator, in Stanislaus County, California.
8.4 CLASS ACTION WAIVER: CLIENT WAIVES ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST THE COMPANY.
8.5 Governing Law
These Terms shall be governed by the laws of the State of California without regard to conflict of law principles.
ARTICLE 9 — GENERAL PROVISIONS
9.1 Entire Agreement
These Terms, together with the Client Services Agreement and Privacy Policy, constitute the entire agreement between the parties regarding the subject matter hereof.
9.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
9.3 Modifications
The Company reserves the right to modify these Terms at any time. Updated Terms will be posted on the Site with a revised Last Updated date. Continued use of Services after posting constitutes acceptance.
